Terms of Service

These terms govern your use of the apps operated by Paddoq (KvK 57715610, Netherlands) — currently Can You Build — and the website at paddoq.ai. By creating an account or paying for an assessment, you agree to these terms. If you don't agree, please don't use the service.

1. The service

Paddoq provides AI-assisted software. Can You Build provides role-agnostic candidate-assessment software. Each app may have additional product-specific terms displayed at sign-up.

2. Accounts

You need a valid email to create an account. You're responsible for keeping your login credentials secure and for everything that happens under your account. We may suspend or terminate accounts that violate these terms, abuse the service, or attempt to charge back legitimate payments.

3. Payment

Apps are paid services. Can You Build uses a prepaid organisation wallet: you top up a balance (minimum €1, maximum €5,000 per top-up) and each assessment deducts a flat €10 when a candidate is added — scenario generation, the candidate's AI-assisted session, and scoring included, with no per-token add-ons. All charges are processed by Stripe; we don't store your card details. Prices are in EUR. VAT is charged where required by law.

4. Refunds

See our separate Refunds Policy. In short: a Can You Build assessment is refunded in full to your wallet if you cancel it before the candidate starts; once the candidate has begun, it is non-refundable because the work has been done. Erroneous charges, technical failures on our side, and duplicate payments are always refunded.

5. Your content

You own the content you submit (prompts, reference images, story text) and the output you generate, subject to the licensing terms of any underlying AI provider we use (e.g. Anthropic). You're responsible for making sure you have the rights to anything you upload — don't submit copyrighted or trademarked material you don't own or have permission to use, don't submit images of real people without their consent, and don't generate content depicting minors in sexual situations, non-consensual sexual acts, or other content prohibited by our AI providers or Dutch law.

6. Acceptable use

Violations may result in immediate suspension without refund and, in serious cases, reporting to Dutch authorities.

7. Service availability

We aim for high uptime but don't promise 100%. Generations may fail (AI providers have rate limits, occasional outages). Failed generations are not charged. We don't guarantee that the AI output will meet your expectations — generative AI is probabilistic by nature; we provide best-effort tools, not specific results.

8. Liability

Paddoq's total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, incidental, or consequential damages. Nothing in this section limits any liability that can't be limited under Dutch law (e.g. for gross negligence or intentional misconduct).

9. Changes

We may update these terms. Material changes will be communicated by email at least 14 days before they take effect. Continued use after the change date constitutes acceptance.

10. Termination

You can close your account at any time from the in-app settings; we'll delete your personal data per our Privacy Policy. We can suspend or terminate accounts that violate these terms, with notice where reasonable.

11. Governing law

These terms are governed by Dutch law. Disputes that can't be resolved by email to support@paddoq.ai go to the courts of the Netherlands.
